Responding to overwhelming feedback from the business community, California Governor Gavin Newsom signed into law last month a bill giving businesses an additional year to comply with new sexual harassment prevention training requirements under Senate Bill 1343. SB 778 amends the sections of the California Government Code created by SB 1343 to make the new deadline for complying with the training requirements Jan. 1, 2021. SB 778 also clarifies some items around which there was some confusion.

What’s changed: Before SB 778, the California Department of Fair Employment and Housing had argued that employers that had conducted anti-harassment trainings in 2018 would need to do so again in 2019 to accommodate the initial deadline to comply. SB 778 clarifies that an employer that completed sexual harassment prevention training in 2018 is compliant with the training requirements and does not need to provide training again until 2020. Similarly, employers that completed their training requirements in 2019 can now wait for another two years to train again, rather than 2020 as many companies previously thought.

What’s hasn’t changed: The anti-harassment training law still applies to all California employers with five or more employees, regardless of where the employees reside and whether they are seasonal, temporary or contract hires. Supervisory employees must still undergo two hours of training once every two years, while non-supervisory employees must undergo one hours of training once every two years. And all new regular employees — or employees newly promoted to a supervisory position — must complete their first training within six months of being hired or promoted, respectively. Temporary or seasonal employees must complete training within 30 days or 100 hours (whichever comes first) of being hired.
